《民事诉讼法》排除了公民个人提起环境公益诉讼的可能性,新《环境保护法》明确了“有关组织”作为适格原告的条件,却没有明确“机关”的范围。我国环保组织发展滞后,环保行政机关又不宜作为环境民事公益诉讼原告。参与环境民事公益诉讼是检察机关行使民行检察职能的重要方式,虽然有现实的困境,但可以是维护环境公共利益的最后守门员,具有提起环境民事公益诉讼的原告资格。
The Code of Civil Procedure ruled out the possibility of individual citizens bringing environmental public interest litigation. The new Environmental Protection Law clearly defined the conditions for “relevant organizations ” as plaintiffs, but did not specify the scope of “organs”. The development of environmental protection organizations in our country lags behind, and the environmental protection administrative organs are not suitable as environmental plaintiffs for public interest litigation. Participating in environmental civil public interest litigation is an important way that procuratorial organs exercise their procuratorial functions in civil communes. Although there are realistic predicaments, they can be the last goalkeeper to maintain the public interest in the environment and have the qualification of plaintiff to bring environmental public interest litigation.
