人权是人因其为人而应享有的权利,是人的基本权利和自由。女性(妇女)人权也是人权。女性也应当和男性一样受到合乎人权的对待。女性人权的实现必须保证妇女获得《世界人权宣言》、《公民权利和政治权利国际公约》和《经济、社会及文化权利国际公约》等中所赋予的全面参与政治、经济、社会和文化发展等权利。本文拟从法理学角度,在国际法层面与中国法层面对女性人权的法律保障体系进行一定比较,指出在中国实施国际人权公约以保护女性人权具有极其深远的文化意义,进而试图对当代中国女性人权的法律保障体系从理论上和实践上予以些完善。
Human rights are the rights that people should enjoy because they are human beings. They are basic human rights and freedoms. Women (women) human rights are also human rights. Women should also receive the same human rights treatment as men. The realization of women’s human rights must ensure the full participation of women in political, economic, social and cultural development as enshrined in the Universal Declaration of Human Rights, the International Covenants on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights right. This article intends to make a comparison from the perspective of jurisprudence at the level of international law with the legal guarantee system of the human rights of women in China. It points out that the implementation of international human rights conventions in China to protect women’s human rights has a profound and far-reaching cultural significance, and then tries to analyze contemporary Chinese women’s human rights The system of legal security should be improved theoretically and practically.
