我国目前的抽象行政行为审查监督制度存在缺陷,主要是没有进行司法性审查监督。重构抽象行政行为的审查监督制度就是要坚持司法性审查监督的原则,兼顾抽象行政行为的多样性和审查监督权的合理分配。基于此,应该在全国人大下面设立一个法规规章审查院审查立法性的抽象行政行为,同时让人民法院来审查行政主体制定的其它规范性文件。在重构抽象行政行为审查监督制度的基础上,抽象行政行为在行政诉讼中的裁判依据地位也应重新界定。
The current system of reviewing and supervising abstract administrative acts in our country is flawed, mainly because there is no judicial review and supervision. To reconstruct the system of censorship and supervision of abstract administrative acts means that we should adhere to the principle of judicial examination and supervision, take into account the diversity of abstract administrative acts and the rational distribution of censorship and supervision. Based on this, an abstract administrative act of reviewing legislation should be set up under the NPC to allow the people’s court to examine other normative documents formulated by the administrative body. On the basis of reconstructing the system of review and supervision of abstract administrative act, the position of the abstract administrative act in administrative litigation should also be redefined.
