随着我国房地产行业的快速发展,房产中介与客户之间的纠纷也在日渐增加,“跳单”行为时有发生。2011年12月20日最高人民法院发布的指导性案例为居间合同关于“跳单”责任的确定,在司法实践方面指明了道路。本文以此案为背景,基于合同法的基本原则、及法律规定对“跳单”责任进行分析,努力提高对实践的指导意义。
With the rapid development of China’s real estate industry, disputes between real estate agents and clients are also increasing day by day. The guiding case released by the Supreme People’s Court on December 20, 2011 is the determination of the responsibility of “jump sheet” in an intermediary contract, which indicates the way in judicial practice. Based on this case, based on the basic principles of the contract law and the law, it analyzes the responsibility of “jumping orders ”, and tries hard to improve the guiding significance to practice.
