我国《宪法》明文规定中华人民共和国人民检察院是国家的法律监督机关,即检察机关是一个监督者。然而,历史上一直存在一个无法回避的悖论,那就是监督者由谁监督、如何监督的问题。2009年最高人民检察院通报:仅1至6月全国各级检察机关共受理违法违纪案件就达145起,其中受到党纪处分的检察干警83人,追究刑事责任的有6人。这一系列案件的发生尽管有着许多因素,但这在很大程度上暴露了当前我国检察机关自身监督机制的不足与完善之重要性与紧迫性。
Our Constitution explicitly stipulates that the People’s Procuratorate of the People’s Republic of China is the legal supervision organ of the country, that is, the procuratorial organ is a supervisor. However, there is always an unavoidable paradox in history, that is, the question of who should supervise and how to supervise. In 2009, the Supreme People’s Procuratorate notified that prosecutors at all levels handled 145 cases of law-breaking and discipline violations in January-June alone, including 83 prosecutors and police officers disciplined by party discipline and 6 criminal prosecutors. In spite of many factors, the occurrence of this series of cases has largely exposed the importance and urgency of the inadequacy and perfection of the current supervisory mechanism of procuratorial organs in our country.
