在我国环境公益诉讼法律制度缺位的情况下,学术界兴起了对建构经济公益诉讼法或者设立专门的环境法庭来审理环境公益案件问题的探究。对环境公益诉讼的宪政价值研究,在我国建立环境公益诉讼制度既有利于实现民主价值,又有利于实现法治价值。 In the absence of the legal system of environmental public interest litigation in our country, the academic circles have risen their inquiry into the construction of the economic public interest litigation law or the establishment of a special environmental court to handle environmental public interest cases. The research on the constitutional value of environmental public interest litigation and the establishment of environmental public interest litigation system in our country are not only beneficial to the realization of the democratic value but also to the realization of the value of the rule of law.
