中国于2013年11月宣布划设东海防空识别区。中国此举在国际社会引起诸多争议。主要是因为防空识别区的出现历史相对较短。它的诞生是为国家的安全所出。在上个世纪的五十年代左右,美国、加拿大率先设立防空识别区,后经过六十多年的反复实践,防空识别区已逐渐发展成为一项国际惯例。虽然它的合法性在国际法理论中存在着诸多争议,但是六十多年的发展,对它的“合法性”也有所建构。本文试将从我国东海防空识别区制度的产生防空识别区的概念、防空识别区的法律地位以及我国划设东海识别区的缘由等方面阐述,试图能够为我国东海防空识别区划设的依据找到存在的立足点。
China announced the designation of the Donghai Air Defense Identification Zone in November 2013. The move by China has aroused many controversies in the international community. Mainly because of the relatively short history of the emergence of air defense identification zones. Its birth is made for the safety of the country. In the fifties of the last century, the United States and Canada took the lead in setting up air-defense identification zones. After more than 60 years of repeated practice, air defense identification zones have gradually become an international practice. Although its legitimacy has many controversies in the theory of international law, the development of more than 60 years has also constructed its “legitimacy ”. This article attempts to find out the existence of the concept of air defense identification area, the legal status of air defense identification area and the reason of setting up the identification area of the East China Sea in China’s East China Sea Air Defense Recognition Zone system, trying to find out the existence of the identification area of East China Sea air defense identification zone The foothold.
