审判权运行机制改革与供给侧结构性改革的要旨不谋而合,均尝试通过资源的优化组合提高供给的能力和水平,对冲不断增长的需求冲击。当下,对审判权运行主体进行中观和微观定位,可以在充分思考各主体利益的基础上,通过制度的创新逐步细化各类人员的岗位职责,增强各主体的改革预期并影响其行动选择,达到优化整合现有司法人力资源和提高司法产品供给质量和效率的目标。从中观层面而言,审判权运行主体定位不能不顾现实,需要以相对合理主义的渐进方式推进,兼顾主审法官、法官助理和其他人员的利益关切;从微观层面而言,必须以各主体为中心架构模式和搭建机制,以先定组合、再定员额、后定人事的外部环境优化和明权、正名、确责、评效、保利五位一体的内部权责利统一的视角统筹规治。
