目的:以非缺陷药物造成的原因为视角,探讨非缺陷药物导致患者人身伤害后的民事责任。方法:采用文献研究和案例分析方法,通过非缺陷药品造成患者人身损害的常见行为,结合相关法律法规来分析其民事责任。结果与结论:非缺陷药品侵权责任应该按照过错责任原则归责,造成损害的患者可以结合实际情况要求侵权人承担相应的责任。 Objective: To investigate the causes of non-defective drugs for non-flawed drugs lead to personal injury patients after the civil liability. Methods: Using literature research and case analysis methods, the common behaviors of patients with non-defective drugs caused by personal injury, combined with relevant laws and regulations to analyze its civil liability. RESULTS AND CONCLUSION: The liability of infringement of non-defective drugs should be attributed to the principle of fault liability. The patients who cause damage may request the infringer to bear the corresponding responsibilities according to the actual situation.
