南海海上石油资源开采的主权问题,一直都是国际上的热点问题,而近年来中国政府提出的“搁置争议,共同开发”的建议,更是引起国内外的轩然大波。根据笔者的观点,此方针的提出只不过是将南海石油开采的主权问题无限制的拖延,对于问题的解决没有任何益处。而中国海上石油资源开采的法定国际投资方式——中外合作开发又明显在存在主权争议的南海海域无法起到应有的作用。那么,如何解决南海石油开采的主权问题呢?在这里,笔者以中国与马来西亚在南海海上石油资源的开采争议为例,讨论新型BOT投资方式在解决南海石油开采问题上的可操作性。
The issue of sovereignty over the exploitation of offshore oil resources in the South China Sea has always been a hot issue in the world. In recent years, the proposal of “suspending disputes and jointly developing” proposed by the Chinese government has even caused a great uproar both at home and abroad. According to the author’s point of view, this principle is merely an unrestricted delay in the sovereignty over the exploitation of the South China Sea oil and will have no beneficial effect on the resolution of the problem. However, the statutory international investment method for exploiting offshore petroleum resources in China - that is, Sino-foreign cooperation and development obviously can not play its due role in the South China Sea where sovereignty disputes exist. So, how to solve the problem of the sovereignty of the South China Sea oil exploitation? Here, I take the Sino-Malaysia dispute in the exploitation of offshore oil resources in the South China Sea as an example to discuss the operability of the new BOT investment mode in solving the South China Sea oil exploration.
