园艺作品是主要利用植物等生命元素创作的新型艺术作品。由于创作材料和创作过程的特殊性,其可版权性在美国的司法实践中遭到了质疑。但版权法的基本原理完全可以涵摄艺术本身的扩张,传统的版权保护条件仍然适用。园艺作品可以视为汇编作品,也可以视为绘画或雕塑。作为艺术家创作结晶的园艺作品,如果满足独创性、可复制性和思想与表达二分法,即具有可版权性,应当给予其版权保护,否则会造成对现代艺术发展的阻碍。
Horticultural work is the main use of plants and other life elements of the creation of new works of art. Due to the particularity of creative materials and creative process, its copyright is questioned in American judicial practice. However, the basic principle of copyright law can fully cover the expansion of art itself, and the traditional copyright protection conditions still apply. Horticultural works can be considered as compilations, or as paintings or sculptures. As a creative horticultural work, artists should give copyright protection if they meet originality, duplicability, dichotomy of thinking and expression, that is, copyright. Otherwise, they will hinder the development of modern art.
