《刑法》对行贿罪法定刑配置,体现了严惩行贿的要求.但是,由于没有贯彻系统性和均衡性原则,出现了“行贿重受贿轻”的法定刑配置,导致行贿、受贿追诉时效倒挂和缓刑适用失衡

《刑法》对行贿罪法定刑配置,体现了严惩行贿的要求.但是,由于没有贯彻系统性和均衡性原则,出现了“行贿重受贿轻”的法定刑配置,导致行贿、受贿追诉时效倒挂和缓刑适用失衡等司法实践困境,这也与党的十九大提出的“受贿与行贿一起查”的要求不符.为此,应遵循法定刑的均衡性、系统性,合理借鉴域外行贿受贿处罚模式,坚持“宽严相济”刑事政策,顺应刑罚轻缓化的趋势,提高刑事立法技术,提高立法的科学化、民主化,构建“严而不厉”的行贿惩治体系.
