舆论监督与司法独立是现代民主法治国家不可缺少的两个基本要素,体现了言论自由与司法公正两种价值。这两种价值的终极目标同为实现社会公平与正义,但在实践中二者又存在着冲突。本文拟从舆论监督以及司法独立的涵义入手,探讨二者之间的关系,进而提出二者冲突的协调路径。
The supervision of public opinion and the independence of the judiciary are two indispensable elements in the modern democratic rule of law. They reflect the two values of freedom of speech and judicial fairness. The ultimate goal of these two values is to achieve social fairness and justice, but in practice there is a conflict between the two. This article intends to start from the meaning of public opinion supervision and judicial independence, discuss the relationship between the two, and then propose the coordination path between the two.
