近几年,“央视春晚”涉及的著作权侵权问题屡见不鲜,为了解决相关利害关系人的利益问题,对“央视春晚”的性质界定则显得至关重要。“央视春晚”既不属于影视作品,也不属于合作作品,而是中央电视台作为法人汇编而成的一部舞台表演艺术作品,将“央视春晚”界定为汇编作品,不仅有利于相关权利人的权利保护,也为我国《著作权法》的立法完善和司法实践可操作性的增强作了铺垫,同时也有利于我国著作权保护长效机制的建立。
