司法体制的建设是民国时期法制建设的重要方面,处于民国前期的南京临时政府和北洋政府时期,虽然当时政治腐败、军阀混战、战争频仍,但在司法体制建设方面仍然取得了一定的进展。本文拟从司法机构的确立与运行、监狱制度的改良与建设、律师制度的初创与发展几个方面,对这一时期的司法体制建设进行梳理,并这对一时期司法体制沿革的历史意义进行探讨。
The construction of the judicial system was an important aspect of the legal system construction during the period of the Republic of China. While in the early period of the Republic of China, the Provisional Government of Nanking and the Beiyang Government were still making some progress in building the judicial system despite the political corruption, warlords and melee warfare. This article intends to sort out the construction of judicial system in this period from the aspects of the establishment and operation of the judiciary, the improvement and construction of the prison system, and the start-up and development of the lawyer system.
