劳动教养制度作为我国特有的一种法律制度,从1955年产生以来,经过50多年的发展和完善,已成为维护社会治安稳定,预防和减少违法犯罪,教育挽救失足人员的重要制度。但随着我国民主和法制建设的不断发展,这种制度在实施中出现了一些问题:劳动教养管理委员会形同虚设,行使劳动教养的审批权缺乏有效的监督机制;劳动教养的法律依据效力不足。
As a peculiar legal system in our country, it has become an important system for safeguarding public order and stability, preventing and reducing crimes and educating and rescuing those who have lost their foot after their development and improvement over 50 years since their birth in 1955. However, with the continuous development of democracy and legal system construction in our country, some problems have appeared in the implementation of such a system: the reeducation through labor management committee is neglected and the power of examination and approval of the exercise of reeducation through labor lacks an effective supervision mechanism; and the legal basis of reeducation through labor is ineffective.
