1 9世纪末 ,中日甲午海战的惨败 ,将鸦片战争以来的中国进一步投入更加愁云密布、风雨飘摇的历史时期。但也正是这无情的现实 ,激励了更多的有识有志之士愈加深刻地思考中国的前途与命运 ,更加强烈急切地寻求救亡图存、富国强民的道路。于是有了维新运动 ,有了法律改制。清末民初中国法律改制其实是整个社会制度变革的一个组成部分 ,而司法独立只是法律改制过程中所表明的一个方面的思路。虽然当时的法律改制在某种方面获得了一定的结果 ,否则也不会有现今中国的法律制度 ;可是这种改制其实并没有从根本上完成 ;否则我们也不会在百年之后旧话重提。张从容的文章给我们较为具体系统地描述了一个历史画面 ,它深刻地提示我们 ,早在百年之前我们的前人所探讨的问题 ,至今还没有解决 ,尽管中国这一百年来的确已经获得了巨大的跨越时代的历史进步。我们今天要探讨的问题不是什么新问题 ,而是一个一百多年的老问题。我们必须承认 ,在某些方面中国依然如故地站在历史的起点 ,并没有前进。难道这个问题真的没有办法解决 ,难道我们真要将这个问题再次留到百年以后吗 ?但无论如何 ,还是必须继续探讨 ,因为这是一个不能不探讨的问题。现今中国如果不能在司法独立的问题上获得突破 ,所谓的现代化进程就会到此为止 ,未
