2003年以来阿根廷与乌拉圭之间的纸浆厂争端,是近年来跨界河流非航行使用争端的一个典型案例。本文通过回顾乌拉圭河纸浆厂争端的由来、双方的辩诉和国际法院的临时裁决,结合相关国际环境法原则,对双方三个主要的争议点进行了简要评析。本文认为,阿根廷因本国团体针对连接阿乌两国的桥梁和道路的阻塞行动而对乌拉圭负有国际责任;乌拉圭批准纸浆厂项目并未违反不造成重大损害的原则;而乌拉圭是否违反了事先通知的义务因而具有程序责任,还存在争议,最终的判定取决于国际法院对事先通知义务进行怎样的理解。
The pulp mill dispute between Argentina and Uruguay since 2003 is a typical case of a dispute over the non-navigational uses of transboundary rivers in recent years. By reviewing the origins of the dispute over the Uruguay River Pulp Mill, the plea of the two parties and the interim ruling of the International Court of Justice, this article briefly reviews the three major issues of dispute between the two sides through the principles of relevant international environmental law. This article argues that Argentina is internationally responsible to Uruguay for its blockade against the bridges and roads linking the two countries to Ukraine and Uruguay. Uruguay’s approval of the pulp mill project did not violate the principle of no significant harm, and Uruguay violated prior notice The procedural responsibility therefore remains controversial and the final decision depends on what the International Court of Justice expects of the advance notice obligation.
