界定相关市场是反垄断法实施中的核心问题。此文主要侧重于互联网相关市场的界定。文章第一部分描述了互联网相关市场的五项基本特征。第二部分介绍中国关于界定互联网相关市场的反垄断立法和有关案件的情形。第三部分推介和阐释了欧盟委员会、德国联邦卡特尔局和德国法院在界定互联网相关市场中应用的理论与方法。文章最后部分提出了关于如何界定中国互联网相关市场的若干建议。
Defining the relevant market is the core issue in the implementation of antitrust law. This article focuses mainly on the definition of the Internet-related market. The first part of the article describes the five basic characteristics of the Internet-related market. The second part introduces China’s antitrust legislation and related cases on defining the Internet related market. The third section introduces and explains the theories and methods used by the European Commission, the German Federal Cartel Bureau and the German courts in defining Internet-related markets. The last part of the article put forward some suggestions on how to define the Internet-related market in China.
