借助人类学决策十字阵的视角,本文通过向下、向上、向前和向后四个面向论述了食品安全权及其法律保障。其中,食品安全权作为一项基本权利顺乎了人的自然本性,即安全食品是人类“来自下方的”一项基本需求,并在“来自上方的”自由和安全的价值衡量中,通过立法目的选择了安全优先兼顾经济的这一价值平衡导向。在此基础上,通过总结过去和启发未来的时间视角,进一步阐述了食品安全立法优先保障安全的历史原因和保障“同一健康”的新兴趋势。
With the perspective of anthropological cross-cutting decision-making, this article discusses the right of food security and its legal protection through four aspects: downward, upward, forward and backward. Among them, the right to food safety as a fundamental right follows the natural human nature, that is, safe food is a basic requirement of human being “from below” and is measured in terms of “free and safe value from above” , The value-balanced orientation of giving priority to both economy and economy through legislative purposes has been chosen. On this basis, we summarize the historical reasons for the priority of food safety legislation and the emerging trend of safeguarding “same health” by summing up past and inspiring perspectives on the future.
