2013年11月23日我国正式对外宣布划设东海防空识别区,有力地巩固和保障了我国在东海海域的国防安全。一些国家对中国的这一行为提出了质疑。为回应这一质疑,可以从不同角度为我国划设东海防空识别区以及未来有可能划设的南海防空识别区提供国际法理论的论证。即我国划设防空识别区的行为是对于专属经济区“剩余权利”理论的合理利用;符合“地空法律地位一致”原则;是对《联合国宪章》中“自卫权”的行使以及划设防空识别区已构成一项国际惯例,以此证明我国划设防空识别区行为的正当性。
On November 23, 2013, China formally announced the delineation of the identification area for the East China Sea Air Defense, effectively consolidating and safeguarding China’s national defense and security in the East China Sea. Some countries have questioned this act of China. In response to this challenge, from different angles for China’s planning of the identification of the East China Sea Air Defense Zone and the possible designation of the South China Sea Air Defense Identification Zone to provide proof of the theory of international law.
