民事法律思维最主要的意义在于其权利理念,民法从某种意义上说就是一部权利法。民事法律思维特别讲究权利的分析,而贯穿其间的请求权基础分析的法律思维更是民事权利体系的枢纽,是民事权利得以实现的保障。民法思维培养对于法学教育来说,首先是在于学生法律思维能力的提高上,其次对于学生对于民法这个庞杂的体系有着更为系统性和逻辑性的认识。本文对民法教学中培养法律思维的方法进行了研究。
Civil legal thinking is the most important significance of its concept of rights, civil law in a sense that is a right law. The civil legal thinking pays special attention to the analysis of the right, and the legal thinking based on the basic analysis of the claim right throughout the process is the pivot of the civil rights system and the guarantee of the realization of civil rights. Civil law thinking training for legal education, first of all, is to improve the ability of students’ legal thinking, followed by students for the complex system of civil law has a more systematic and logical understanding. This paper studies the methods of cultivating legal thinking in civil law teaching.
