用刑法来保护人民既不总是必要的,也不总是充分的,它注定是一项不可能完成的任务。刑法虽然保障犯罪人的人权,但是刑法绝不仅仅保障犯罪人的人权,遑论以刑法保护犯罪人。被害人运动则几乎对刑法学没有带来什么影响,最新发展出来的被害人信条学和被害人的自我答责原则反而指出了在刑法领域内限缩对被害人的保护之趋势。希望通过刑法来保护一般公民也已经为实践和历史所驳斥。究其原委,实体性的人及其利益根本不能成为观念性的刑法的保护对象,毋宁说刑法保护的是观念上的守法者。
It is not always necessary, and not always sufficient, to protect people by criminal law, which is bound to be an impossible task. Although the criminal law protects the human rights of criminals, criminal law does not only guarantee the human rights of criminals, let alone criminal law to protect criminals. The victim movement almost did not bring any impact on the criminal law. The newly developed principles of the victim’s creed and the victim’s self-responsibility pointed out the trend of restricting the victimization in the field of criminal law. The hope that the protection of ordinary citizens through criminal law has also been refuted by practice and history. Investigating the whole story, the substantive person and his interests can not become the object of protection of conceptual criminal law at all, rather, the criminal law protects the concept of law-abiding persons.
