八届全国人大二次会议通过,1995年1月1日开始实施的《中华人民共和国劳动法》(以下简称《劳动法》)是以保护劳动者合法权益为宗旨,全面调整劳动关系的基本法律。《劳动法》能否得到全面贯彻实施,直接关系到劳动者的合法权益能否得到有效保障,稳定和谐的劳动关系能否真正建立。这对于我国的改革开放、经济发展和社会稳定,都将产生极为重要的影响。最近笔者随全国人大《劳动法》执法检查组到我省的一些地方,对《劳动法》执行情况作了调查。总的看来,《劳动法》的执行初见成效,但存在的问题也不少。
The “Labor Law of the People’s Republic of China” (hereinafter referred to as the “Labor Law”), which was passed at the Second Session of the Eighth NPC, became effective on January 1, 1995, is the basic law that comprehensively adjusts the labor relations with the objective of protecting the legitimate rights and interests of laborers . Whether the “Labor Law” can be fully implemented or not is directly related to whether the legitimate rights and interests of workers can be effectively protected and whether stable and harmonious labor relations can be established. This will have an extremely important impact on China’s reform and opening up, economic development and social stability. Recently, with the NPC Law Enforcement Inspection Team of Labor Law Department in some places in our province, I conducted an investigation on the implementation of the Labor Law. In general, the implementation of the “Labor Law” has achieved initial success but there are still many problems.
