不动产登记簿的形式拘束力不但要求登记机关原则上不得依职权办理不动产登记簿的更正,而且还禁止当事人就登记机关做出的登记决定提起控告,因而与行政行为之公定力有着显著区别,需要民事法律对此做出特别规定;在发生登记错误的情况下,权利人只能通过物权法所规定的不动产登记簿之更正制度恢复不动产登记簿的正确状态。不动产登记簿之形式拘束力对于维持不动产登记之公信力,对于解决确权之诉的程序选择问题,对于正确理解不动产登记簿之更正制度,具有极其重要的意义。考虑到我国物权法已经确立不动产登记之公信力,并就不动产登记簿之更正做出明确规定,因此承认并强化不动产登记簿之形式拘束力应是大势所趋。
