【裁判要旨】电子邮箱标识以其绘画、色彩等方式形成具有审美意义的平面或立体造型,构成著作权法所保护的美术作品。未经著作权人许可,通过信息网络向公众传播作品的,应承担停止侵权的民事责任;擅自使用知名商品特有的名称、包装、装潢,或者使用与知名商品近似的名称、包装、装潢,造成和他人的知名商品相混淆,使消费者误认为是该知名商品的行为,构成不正当竞争,应承担赔偿损失的民事责任。
