1996年3月17日颁布的《中华人民共和国行政处罚法》首次以立法的形式规定了听证程序,从而标志着听证制度在我国的初步确立.在行政处罚领域,听证程序是行政机关在作出重大行政处罚决定之前,为了查明案件事实、公正合理地实施行政处罚,而公开举行的、听取有关利害关系人意见的活动方式、方法和制度.根据普遍适用的原则,消防行政处罚的决定和实施也必须符合《行政处罚法》中有关听证程序的规定.本文试图就消防行政处罚中有关听证程序的应用问题谈几点认识:一、关于听证程序的适用范围根据《行政处罚法》第42条关于听证适用范围的规定,结合消防监督管理工作实际,消防行政处罚中适用听证程序的处罚有三种:(一)责令停产停业.它是公安消防部门对违反消防管理规定的单位所给予的一种责令其停产停
