一百年前,孙中山先生担任临时大总统的中华民国在南京成立,中国的历史翻开了新的一页。随后,《中华民国临时约法》颁布,中国学习西方法治的探索迈出了重要一步。一百年后的今天,我们依然在法治道路上摸索前进,在这一进程中,法律传承已成为与法律移植并重的重要面向。接续传统以更好地走向未来,则逐渐得到了更多认同。为此,本刊特约请武树臣教授和徐爱国教授撰稿剖析中华法系的成因与发展历程,解读现代中国法律思想的渊源,并汇集青年学者关于传统法律研究的最新成果组成专题,以期推动对一百年来法治探索和几千年传统法律文明的讨论。
A hundred years ago, the Republic of China, where Dr. Sun Yat-sen served as provisional president, was established in Nanjing. China’s history has opened a new page. Subsequently, the promulgation of the Provisional Constitution of the Republic of China was an important step toward exploring China’s exploration of the rule of law in the West. Today, a hundred years later, we are still groping for progress on the path of the rule of law. In this process, legal inheritance has become an important aspect of attaching importance to legal transplantation. Following the tradition in order to better move toward the future, we have gradually gained more recognition. To this end, we hereby invite Professor Wu Shichen and Professor Xu Aiguo to make an analysis of the causes and development of the Chinese legal system, interpret the origins of the modern Chinese legal thought and bring together the latest achievements of the young scholars on traditional legal research, with a view to promoting One Hundred Years of Exploration of the Rule of Law and Discussion of Traditional Legal Civilization for Thousands of Years.
