6月17、18日,武汉市中级人民法院召开审理房地产开发案件研讨会,到会的有各区、县法院分管民事审判的院长、民庭庭长以及特邀的市政府法制办,市城建委、市房地局的领导,武汉大学、中南政法学院,省、市民法学界的专家、教授和部分房地产开发公司的经理,他们就房地产开发案件的类型、特点及审理这些案件应遵循的法律原则、审理对策等,进行深入的研究和讨论。现将有关情况综述如下:一、房地产开发案件的主要特点与会者认为,房地产业是我国的一项新兴产业,房地产开发案件也是人民法院近一、二年所面临的一个新课题,涉及的法律关系复杂,审理过程中遇到的一些新情况和新问题,是其他类型的案件所没有的,概括起来主要是:1.诉讼标的额大,引起诉讼除了个别是房地产
