行政合同作为一种较为新颖而有效的管理方式已为现代国家所普遍采用。行政合同的有关理论问题已越来越为学者所重视,本文主要对行政合同的性质作了初步的讨论,笔者认为行政合同的性质具有行政性和合同性两个方面。 Administrative contract as a more innovative and effective management has been widely adopted by modern countries. The related theoretical issues of administrative contract have drawn more and more attention from scholars. This article mainly discusses the nature of administrative contract. The author thinks that the nature of administrative contract has both administrative and contractual aspects.
