刑法第57条第1款规定:“对于被判处死刑、无期徒刑的犯罪分子,应当剥夺政治权利终身。”对于本条款的适用,一致的见解认为,无论犯罪分子犯何种罪行,只要实际的宣告刑为死刑(包括死缓)或者无期徒刑,都应当(附加)剥夺政治权利终身。但第57条第1款还存在另外的一种解释可能。从体系解释的角度看,本条是承接第56条而来的,如果以此为前提来理解第57条,其含义则可以理解为:对于应当或者可以附加剥夺政治权利的犯罪(即符合第56条第1款的规定),如果该犯罪人被判断死刑或者无期徒刑,则应当(附加)剥夺政治权利终身。换言之,适用第57条第1款需要以适用第56条为前提。
