从法律文化的二元结构入手,分析了制度性法律文化和观念性法律文化在我国学校教育中的现实表现。明确指出有关学校教育的法律制度是先进的、现代化的,符合我国学校教育的发展要求;但人们的法律意识和行为方式还跟不上法律制度的发展,缺乏与之相匹配的观念性法律文化的支撑,学校教育保障乏力。同时提出了要实现我国学校教育现代化,使学校教育健康发展,必须从制度出发,配置和完善相关的法律制度;高度重视对人的教育和培养,尤其是对人的法律文化心理和法律价值观的教育和培养,促其由传统形态向现代形态转变,使观念性法律文化与制度性法律文化相协调,实现文化整合,才是我国学校教育现代化之急需。
Starting from the dual structure of legal culture, this paper analyzes the actual performance of institutional legal culture and conceptual legal culture in our school education. Clearly pointed out that the legal system of school education is advanced and modern, which is in line with the developmental requirements of our country’s school education.
