文章通过对近年来各种将有关权利入宪的主张进行反思,提出应认真对待宪法权利。从中西权利观以及对宪法权利认识与表现的异同,宪法权利的应然形态也存在较大的差异,宪法权利的应然性特征要求我们认真对待宪法权利的主旨是一致的。 In this paper, through rethinking all kinds of opinions about the incorporation of relevant rights into the constitution in recent years, the article proposes that the constitutional rights should be taken seriously. From the view of right and wrong between China and the West and the similarities and differences of understanding and representation of constitutional rights, there are big differences in the form of constitutional rights. The nature of constitutional rights requires us to take the constitutional rights seriously.
