自由、民主是网络信息发布的特点,也是网络媒介的活力所在。普通民众从此能够实现政治参与、表达民意、引导和分化社会舆论和权力监督。但与此同时,互联网引发了一系列侵害隐私事件,例如,在网络空间中,日益增多的侮辱、谩骂、造谣中伤、侵犯隐私、网络欺诈、黑客入侵等网络不文明甚至违法犯罪行为。本文是对韩国网络实名制的综合性研究,它包含了立法起源、历程、论争内容、管理和有效性等多角度的解释等制度评价。第一个问题是:韩国网络实名制的立法起源是什么?讨论的议题是什么,哪些议题进入立法过程?第二个问题是:有关网络实名制赞成和反对论争来自哪些势力?支持和反对的根据是什么?第三个问题是:介绍具体的制度内容和管理方式并分析制度的有效性,管理方式是否完整及网络暴力是否减少。 Freedom and democracy are the characteristics of the network information dissemination, but also the vitality of the network media. Since then, ordinary people have been able to achieve political participation, express popular opinion, guide and differentiate public opinion and power supervision. At the same time, however, the Internet has triggered a series of privacy incidents. For example, in cyberspace increasingly insulting, abusive, slander, invasion of privacy, phishing, hacking and other cybercrime and even criminal activities. This article is a comprehensive study on the real-name system of Korean networks. It includes the institutional evaluation of the origins, history, content of controversy, management and validity from multiple perspectives. The first question is: What are the origins of the legislation on Korean real-name network? What are the topics for discussion and which issues go into the legislative process? The second question is: What are the forces on the pro-and opposition to cyber-naming? The basis for support and opposition is What? The third question is: to introduce the specific system content and management methods and analysis of the effectiveness of the system, the management is complete and the network violence is reduced.
