不久前国务院出台了《国务院关于切实加强艾滋病防治工作的通知》,通知中着重强调加强我国对艾滋病的防治工作,其力度是此前少有的。从上面的案例我们可以看出正是由于曾经对艾滋病的防治不力才会给像韩明这样的患者造成无法挽回的损失。然而,时至今日韩明们却无法用法律维护自己的权利,归根到底是法律的缺失造成的。在此记者请来了上海大学法学院艾滋病法研究中心主任杨绍刚。 [主持人]:本案中的韩明等人由于使用的药品受到了污染而感染了艾滋病。究竟该由谁来对他们负责任呢?
Not long ago, the State Council promulgated the “Notice of the State Council about Earnestly Strengthening AIDS Prevention and Control Work”. The circular emphasized the importance of strengthening China’s efforts to prevent and control AIDS, which was previously rare. From the above case, we can see that it is precisely because of the poor prevention and treatment of AIDS that would cause irreparable damage to patients like Han Ming. However, until now, Han Ming can not use law to defend their own rights, in the final analysis is caused by the lack of law.
