在相互依赖的国际社会中,国际交往的本质是以国家权利的让渡为内容的交易活动,其同样存在交易成本。国际法为国际交往提供了制度保障,其功能在于通过产权界定、促进信息交流等方面来降低交易费用,促进国际合作。制度经济学中的交易成本理论为分析国际法的功能提供了新的研究视角,降低国际间的交易成本是分析国际法之“合法性”的内在依据。
In the interdependent international community, the essence of international exchanges is the transaction activity based on the transfer of state rights, which also has the transaction costs. International law provides institutional guarantees for international exchanges. Its function is to reduce transaction costs and promote international cooperation by defining property rights and promoting information exchange. The transaction cost theory in institutional economics provides a new perspective for the analysis of the functions of international law. Reducing the transaction costs in the world is the internal basis for analyzing the “legitimacy” of international law.
