班轮公会依其反垄断豁免特权一度对国际海运实施绝对控制。然而随着欧盟正式立法废止班轮公会的反垄断豁免特权,班轮公会垄断海运的时代即将结束。鉴于海运行业的特殊性,“后班轮公会时代”必须要有能够替代班轮公会保障船运公司生存发展但又不失公平竞争的合作方式。经过分析预测得出,满足上述要求的未来船运公司合作方式为联营体为主、战略联盟为辅的模式。
The liner convention once exercised absolute control over international seaborne over its privilege of antitrust exemption. However, with the EU’s formal legislation abolishing the anti-monopoly exemption privileges of liner conventions, the era of monopoly of shipping by liner associations is coming to an end. In view of the particularity of the maritime industry, the “post-liner conference era” must have a cooperation mode that can replace the liner conference to guarantee the survival and development of shipping companies without losing the fair competition. After analysis and forecast, the cooperation mode of the future shipping companies that meet the above requirements is the mode of association-based and supplemented by strategic alliance.
