长期以来,我国以颁发取水许可证的方式规范水资源的配置、监管水资源的使用。但显而易见,由于政府主导的行政许可模式,过于注重政府的命令与控制,不利于调动各参与方的积极性,显得过于僵化,已经不能适应现实的需要,也无法为我国正在兴起的水权市场的培育与发展创造条件。在水资源利用与管理过程中,引入行政合同,补充或替代行政许可模式,明确水资源管理部门与取水许可申请人的权利、义务及责任,不但可以提高政府水资源配置与管理的效率,而且可以调动被许可人的积极性,提高水资源的使用价值,减少水资源利用过程中的浪费及对环境的损害,同时减少用水过程中用水人与管理机关以及与其他利益相关人的纠纷,进而为我国水权交易市场的培育与发展创造条件。
