自20世纪后期以来,我国个人计算机开始大量普及,以网络为介质的虚拟财产开始大量出现。2003年,我国出现了关于虚拟财产的第一起诉讼案件,即北京市朝阳区法院审理的“红月案”;2008年,深圳市南山区又对盗窃QQ号码一案做出了判决。短短几年,虚拟财产案件已经从普通的民事纠纷升级到刑事犯罪,但是我国的刑事立法还没有明确保护虚拟财产。本文从虚拟财产的法律性质入手,对刑法是否应当对虚拟财产给以保护加以探讨。
Since the latter part of the 20th century, personal computers in our country have started to popularize extensively, and the virtual property with network as the medium has started to appear in large numbers. In 2003, the first lawsuit case about virtual property appeared in our country, namely “Red Moon Case” trial by Chaoyang District Court in Beijing; in 2008, Nanshan District, Shenzhen again made the judgment on the theft of QQ number. In just a few years, the cases of virtual property have been upgraded from ordinary civil disputes to criminal offenses, but our country’s criminal legislation has not explicitly protected virtual property. This article starts from the legal nature of the virtual property and probes into whether the criminal law should protect the virtual property.
