近些年来,随着我国社会主义市场经济建设的深入和依法治国方略的逐步实施,律师规模迅速扩大。截至2002年12月,全国执业律师人数近12万人,律师事务所数量达到1万家。总体来看,律师事务所呈现出两大特点:一是人数在十人以下的小型所居多,占总数的90%;二是事务所多数集中在大中城市。例如,截至2002年10月15日,甘肃省通过2002年年检注册的共197家律师事务所、1245名专兼职执业律师。其中有675名在兰州市的80家律师事务所执业。就是说,该市集中了甘肃全省半数以上的律师。 不难看出,我国律师业发展仍然处于初级状态。虽然已经涌现出一批具备一定规模、管理规范的律师事务所,但和法律服务市场激烈竞争的局面并存的是律师业令人失望的现状:多数事务所合久必分,始终做不大。
In recent years, with the deepening of China’s socialist market economy and the gradual implementation of the strategy of governing the country according to law, the scale of lawyers has rapidly expanded. As of December 2002, the number of practicing lawyers nationwide reached nearly 120,000, and the number of law firms reached 10,000. Generally speaking, law firms have two major characteristics: one is the small number of people who occupy less than 10 persons, accounting for 90% of the total; and the other is that the majority of firms are concentrated in large and medium-sized cities. For example, as of October 15, 2002, 197 law firms and 1245 part-time lawyers who passed the 2002 annual inspection in Gansu Province were registered. Of these, 675 law firms operate in Lanzhou. In other words, the city has more than half of lawyers in Gansu province. It is not difficult to see that the development of China’s legal profession is still in its infancy. Although a number of law firms with a certain size and well-regulated regulations have emerged, the fierce competition with the legal services market is a disappointment for the lawyers: most firms have not done much in the long run.
