李律师:本人原是肇庆市某水电局属下防汛船固定工,1997年已到劳动部门办理了退休证。2000年10月,由于本人原工作的防汛船转卖,水电局给我发来通知,要我回水电局领取1万多元的“遣散费”,并于当月停发了我的退休金。本人于11月份向当地劳动仲裁委员会提出申请,经了解本人个人部份社保费已于退休前交清,单位部分没有交,我退休时也没有给我打“白条”,调解后社保局要求水电局为本人缴纳单位应缴部分保险费和一定量的滞纳金,水电局以没有钱为由,至今仍不给我一个答复。我想问一下:退休工人可以遣散吗?如果现在连劳动仲裁的人也爱理不理了,我该用什么方式去维护自己的权利?在发生劳动争议期间我停发了的退休金,可否要求单位给予支付?深切期盼你答复的容生
Li Lawyer: I was originally a flood control vessel under Zhaohui City, a hydropower station fixed workers, to the labor department in 1997 for the retirement permit. In October 2000, due to the reselling of the original flood control ship, the hydropower bureau sent me a circular asking me to return to the water and electricity bureau for a “severance payment” of over 10,000 yuan and suspended my pension in the same month. I submitted an application to the local Labor Arbitration Commission in November. After I learned that my personal part of the social insurance premium has been paid before my retirement, I did not pay any part of the flat. When I retired, I did not call me “white stripe”. After the mediation, the Social Insurance Bureau called for the hydropower The bureau pays part of the insurance premiums and a certain amount of late fees for its own payment. The Bureau of Water Supplies still does not give me a reply because of the lack of money. I would like to ask: Can retired workers be demobilized? If so, even the people who arbitrate the labor arbitration are indifferent to me? In what ways should I defend my rights? Can I suspend my pension during a labor dispute? Ask the unit to pay?
