平潭综合实验区的建设正如火如荼地进行。除了硬件环境以外,法制建设无疑是其制度软环境构建的核心组成部分之一。应当注意的是,平潭的“实验区”定位与之前其他地方“试验区”定位有所不同,这反映了平潭综合实验区的独特性质及其背后特殊的政策安排。在此基础上,该区立法地位和行政地位的法律确认同样具有关键意义。此外,对具体法制建设中所面临的立法定位、制定依据以及立法的内容与特色等问题的关注和回应也同样具有重要的理论和实践意义。
