近十年来,我国就业歧视法学研究的大部分力量,都投入到探求一个既有理论概括性、又具实务指导性的就业歧视法律概念之中;虽然国家层面的立法尝试尚付阙如,地方层面的零星探索却引人注目。本文拟在综述现有研究成果的基础上,提出就业歧视法律界定的新思路,并对这一问题给出一种可能的解答。
In the past ten years, most of the forces of legal research on employment discrimination in our country have been devoted to seeking a legal concept of employment discrimination both in theory and in practice. Although legislative attempts at the national level are still under-paid, the local level Sporadic exploration is compelling. Based on the review of the existing research results, this article proposes a new idea of the legal definition of employment discrimination and gives a possible answer to this question.
