西汉中期以后儒家法律思想逐渐取代了原存在于上层统治者思想中的黄老思想,并成为此后中国古代法制的主要指导思想,“德主刑辅”法律思想是其重要产物。该思想要求治理国家要使用礼义教化和法律相结合的双重手段,礼义教化为其根本,刑法刑罚则是辅助。这一法律思想极大影响了汉朝乃至整个中国古代法律制度,在中国盛行千年、历久不衰,不仅在中国法制史上留下了笔墨浓重的色彩,也对当代法治社会的建设有着重要的借鉴意义。
