审判要旨在小区发生重大事故或者紧急事件需要及时处理的情况下,经20%的业主提议,业主委员会应当及时组织召开业主大会临时会议。但如果业主委员会不组织召开,并经街道办事处责令其限期召开仍拒绝召开的情况下,居委会在街道办事处的指导下组织召开临时业主大会符合法律规定,临时业主大会的决议如果符合《物权法》第76条规定的,应具有法律效力。
