本文基于软件市场规模经济和网络外部性的特点,构建了扩展的单寡头垄断模型、伯川德模型和豪泰林模型将软件市场区分成四种典型的市场结构,进而研究软件市场结构和软件保护不同方式的作用机理。研究表明,在软件的规模经济特性、网络外部性及IP法律保护等因素的影响下,在市场结构不同的软件市场,软件厂商强化传统价格和产品差异化等竞争手段的同时,会选择不同的最优源码保护程度展开市场竞争,从而导致不同的创新成本和软件质量,并且市场结构的不同也影响了最优的IP法律保护程度。
