现行行政复议受案范围存在着范围狭窄、逻辑混乱等严重不足,难以达到对权力监督和权利保障的目标,迫切需要用一种新的模式来进行全新改造。负面清单模式的权利保障目标与低成本高效益的价值取向符合行政复议受案范围改造的趋势,可引入负面清单模式对行政复议受案范围进行重新改造。先规定一个可以提起行政复议的概括性范围,在此前提下,列出不能提起行政复议的负面清单,不在负面清单范围的都是可以提起行政复议的事项,从而既充分扩大行政复议受案范围、节约立法成本,也解决受案范围事项归类上的逻辑混乱现象。采用负面清单模式设计行政复议受案范围时,还必须建立行政复议登记受理制度、改造复议组织以及做好行政复议与行政诉讼衔接等相关配套措施,使行政复议受理范围的扩大真正落到实处。
