澳大利亚高等法院对宪法第51条第31项中的财产条款采用广义的解释方法,使得“财产”和“财产取得”获得广义的理解,因此财产和财产取得的范围极其广泛。联邦对财产的取得不限于对财物以及与财物有关利益的取得,还延伸到对企业主要领导成员的任免、诉讼产等方面。对于“公正的条件”的解释也逐步提高了标准,加大了对当事人的补偿。澳大利亚高等法院的这些解释,有力地保障了公民的财产权。澳大利亚的做法至少可以给我国提供三方面的借鉴意义。
The Australian High Court adopts a broad interpretation of the terms of property in article 51, paragraph 31, of the Constitution, which gives a broad understanding of “property” and “acquisition of property”, so that the range of property and property acquired is extremely wide. The acquisition of property by the Federation is not limited to the acquisition of property and the related interests of property, but extends to the appointment and dismissal of major leading members of enterprises as well as the production of litigation. The interpretation of “fair conditions” has also gradually raised the standard and increased the compensation for the parties. These interpretations by the High Court in Australia have effectively protected citizens’ property rights. Australia’s approach can at least provide our country with three aspects of reference.
