人民主权、权力分工和制约、基本人权保障等宪法原则决定了代议机关所制定的授予行政机关立法权之授权法必须符合“授权明确性原则”。从比较法的角度观察,授权法应明确规定哪些授权要素并无一定之规。至于授权立法的程序,也不是授权法必须明确规定的要素。在违宪审查视域内,“授权明确性原则”并不要求授权法须明文指示授权的目的、范围、内容等授权要素。而授权明确性审查标准的确定应遵循两项基本规则,即不同主体的立场、授权立法所采取的规制手段的轻重与所要规制的权利类型决定了“明确性”审查标准的宽严程度。
Constitutional principles such as the people’s sovereignty, the division of powers and restrictions on human rights, and the guarantee of basic human rights determine that the law of delegation granted by the representative agencies to the executive authorities must comply with the “principle of the principle of the clarity of authorization.” From the perspective of comparative law, the law of empowerment should clearly stipulate which elements of empowerment do not have certain rules. Nor is the procedure for empowering legislation an essential element of the law of authority. In the field of unconstitutional review, the “principle of the clarity of authority” does not require that the law of authorization should explicitly indicate the authorized elements such as the purpose, scope and content of the authorization. The determination of the vetting clarity standard should follow two basic rules, that is, the position of different subjects, the weight of the regulatory measures taken to authorize the legislation and the type of rights to be regulated determine the degree of strictness of the censorship standards .
