第一条为了贯彻「发展生产,繁荣经济,公私兼顾,劳资两利」的经济政策与劳动政策,特制定本办法。经二条本办法适用一切私营工商企业。第三条私营企业主(以下简称资方)与被僱用之工人、职员、店员、学徒及杂务人员(以不简称劳方)之间的关系,凡属本办法未规定者,得由劳资双方协议,答定集体合同或劳动契约规定之。但集体合同或劳动契约不得与本办法之内容相抵触。附注:集体合同系为规定劳资双方之权利义务的一定时间的画面合同,在同一行业之劳资双方,可订立同一行业或产业之总的集体合同,在一个工厂企业中的劳资双方亦可订立单独的集体合同。劳动
